TERMS OF BUSINESS
For the introduction of permanent staff
These terms of business are
between Vanilla Consulting (ABN 71 182 465 695) and the Client
Employer and are current until such time as new terms of business
are notified by Vanilla Consulting.
Acceptance of resumes from Vanilla Consulting and/or the interviewing
or engagement of a candidate put forward for a Client Employers
consideration will constitute acceptance by the Client Employer
of these terms of business. The Client Employer will keep
the candidates information as confidential at all times.
The client agrees to de-identify personal information provided
by Vanilla Consulting in the event that this information is
no longer required for the purposes in which they were collected.
Vanilla Consulting will use its best endeavours at all times
to ensure that the candidates that it presents to its Client
Employers are suitable for the position to be filled.
Any classified or display advertising carried out for a Client
Employer shall be subject to prior authorisation by the Client
Employer and will be charged to the Client Employer at cost.
Vocational, aptitude and skills testing can be provided if
required at the cost of the Client Employer.
In the event that an offer of employment is made either directly
or indirectly to a candidate submitted by Vanilla Consulting
to the Client Employer within 12 months of the provision of
the candidates details or within 12 months of the date of
completion of any contract by a Vanilla Consulting candidate,
or as a result of an introduction by the Client Employer to
any other division or related or associated company or firm
or to any other employer which results in an offer of employment
or a contract position to the candidate, the Client Employer
will be liable to pay a fee in accordance with the fee schedule.
The Client Employer is responsible to ensure that adequate
supervision and instruction is given to the employee and that
the workplace in which the employee is placed complies with
all OH&S and other relevant legislation and best practice.
Vanilla Consulting agrees to make every reasonable effort
to ensure the suitability of the applicant on behalf of the
Client Employer but cannot accept any responsibility for any
loss, damage, expense, or delay however occasioned and the
Client Employer agrees to satisfy itself as to the references
provided and that all medical or other requirements or qualifications
have been met.
The final decision to employ a Vanilla Consulting candidate
rests with the Client Employer.
Vanilla Consulting guarantees all permanent placements for
a period of 12 weeks from the date of employment. Should the
candidate prove unsuitable within this period of time, Vanilla
Consulting will undertake to replace the candidate at no cost
or will refund 50% of the recruitment fee.
This guarantee will be null and void if the recruitment fee
was not paid within the agreed terms of 7 days net of the
invoice or if the candidates position is declared redundant
or the position description or working conditions are changed
in any way.
All fees incurred for the collection of any overdue accounts
may be passed on to you at the discretion of Vanilla Consulting.
In the event of non-payment, we reserve the right to charge
an account keeping fee at a flat rate of 1% per month on unpaid
invoices from the due date to the receipt of payment.
For the introduction of temporary staff
Acceptance of resumes from Vanilla
Consulting and/or the interviewing or engagement of a candidate
put forward for the Client Employer’s consideration
will constitute acceptance by the Client Employer of these
terms of business. The Client Employer will keep the candidate’s
information as confidential at all times. The Client Employer
agrees to de-identify personal information provided by Vanilla
Consulting in the event that this information is no longer
required for the purposes in which they were collected.
Vanilla Consulting will use its best endeavours at all times
to ensure that the candidates that it presents to the Client
Employer are suitable for the position/s to be filled.
Any classified or display advertising carried out for the
Client Employer over and above the standard agency advertising
shall be subject to prior authorisation by the Client Employer
and will be charged to the Client Employer at cost.
Vocational, aptitude and skills testing can be provided if
required at the cost of the Client Employer.
You are responsible to pay our hourly fee, as agreed at the
time of booking, for all hours worked by the temporary employee.
You will be required to sign weekly timesheets that we rely
on as an authority to process payment to the temporary worker
and confirmation of your satisfaction. However, failure to
sign the timesheets does not alter your liability to pay for
the hours worked.
The temporary worker has been paid by the time you receive
our invoices and therefore our fees must be paid immediately
upon receipt of invoice.
